Is my Wine Included? Does my Wine need an e-label?

What is acceptable:

  • it is acceptable to have a QR Code on the label that leads to nutritional information and a list of ingredients, HOWEVER, the current format of the Scantrust electronic label is not accepted as it does not

Legal Text

Products produced before 8 December 2023 are exempt from the obligation to comply with the Regulation.
(The amendment removed the word “labelled” in July 2023)

Interpretation

  • Still wines:
    • Primary alcoholic fermentation completed and required alcohol content and acidity achieved
      • 1308/2013: at least 3.5 grams of tartaric acid
    • The 2023 vintage in Europe is excluded mainly because alcoholic fermentation is completed before December 8, 2023 for wines in Europe - the 2024 vintage is affected
    • NOTE: if alcoholic fermentation of the 2023 harvest is only reached after December 8, 2023, it is not an exception.
  • Sparkling wines:
    • The second fermentation occurred and the product reached its alcohol content and overpressure conditions.
      • 1308/2013: at least 8.5% alcohol and at least 3 bar excess pressure (8% and 3.5 bar for quality sparkling wines)
    • The 2023 harvest or even previous harvests are affected, depending on the stage of production of the product on December 8, 2023
    • NOTE: If a 2021 vintage has not completed second fermentation by December 8, 2023, it is not exempt.
    • Other products, such as aromatized wine, follow a similar logic.

  • Workaround - available to corporate customers ONLY:
    • Create digital wine labels
      • include the necessary information
      • both the nutritional table and the list of ingredients must be formatted according to Canadian graphic and technical requirements
      • save the images online (if you have already saved this information as an image on your website, a link to that image on your website will work)
    • add a "Tag" called "Canadian Label" to your campaign
      • store the respective image URL in this "Tag" for each QR Code (update of the SCM field)
    • create a landing page called: "Canadian Wine Label"
      • use the "image widget - link" function and type
        @
in the dropdown menu that appears, select "Canadian Label"
      • set up your campaign so that your e-label information is shown in the EU and your "Canadian Wine Label" landing page is shown in Canada
